Regarding the video message of the deputy director of Khamza Group LLP circulating in social media, NU informs, that on October 17, 2022, NU’s subsidiary “University Service Management” (after this – the Customer) signed a Contract with Khamza Group LLP (after this – the Contractor) on provision of services, based on the open tender results.
According to the Contract, the Contractor was to renovate the granite basement in four blocks (university buildings). The completion of work under the Contract was due on December 15, 2022. However, the Contractor violated the terms of the Contract, resulting in a delay of 16 calendar days. Moreover, the Contractor performed works only in one block out of four. Work defects were found, evidenced by the Act of Identified Defects signed by the parties on February 03, 2023.
The Contractor also violated his obligations under the Contract by not providing the Customer with data for approval on the materials used in the renovation.
On December 29, 2022, the Contractor sent the Customer a letter of guarantee, according to which he undertook to complete the works by January 09, 2023, which did not correspond to the terms and requirements of the concluded Contract. Thus, the Contractor failed to fulfill his contractual obligations in complete and acceptable quality in due time.
Given the above and the expiry of the Contract, and according to paragraph 3 of Article 386 of the Civil Code of RK, signing the Act of Completed Works is not possible.
The allegation by the Contractor that the Customer did not provide access to the university campus for the Contractor to complete the work is false. The Contractor has been granted access to the site until January 14, 2023.
The Contractor was also informed that the company might be included in the list of unreliable suppliers of NU, which will limit the company’s ability to participate in future procurements.
Based on the above, the claims and accusations made by the Contractor in the video are false.
